THIS INDENTURE made the day of 2nd day of November 1920
BETWEEN BENJAMIN TILLSTONE ROGERS-TILLSTONE of Moulse Coomb Place Patcham but now in Brighton in the County of Sussex Esquire (hereinafter called "the Vendor") of the first part CHARLES CHRISTOPHER DAVIE of Hove Solicitor and ANNIE PRANCES DAVIE of The Elms Bishop Tawton Barnstable in the County of Devon Spinster of second part ARTHUR FOSTER GRIFFITH of 47 Old Steine Brighton in the County of Sussex aforesaid Solicitor of the third part ADELAIDE DOROTHY TRACY of Broadwater in the County of Sussex aforesaid Spinster of the fourth part and THE MAYOR ALDERMEN AND BURGESSES OF THE COUNTY BOROUGH OF BRIGHTON (hereinafter called "the Corporation") of the fifth part
WHEREAS the Vendor is seised for an estate of inheritance in fee simple in possession subject to the tenancies therein existing of all and singular the freehold land and hereditaments situated in the Parishes of Patcham and Preston Brighton in the County of Sussex aforesaid more particularly described in the First Schedule hereto and intended to be hereby granted and conveyed All of which said lands and hereditaments are delineated in the plan annexed hereto and thereon coloured blue pink and green subject AS to such part thereof as is coloured blue on the said plan (a) To an Indenture of Mortgage dated the 2nd day of April 1903 and made between the Vendor of the one part and the said Charles Christopher Davie and John Granger Mudge of the other part whereby the land and hereditaments coloured blue together with other hereditaments were conveyed to the use of the said Charles Christopher Davie and the said John Granger Mudge and their heirs by way of Mortgage for securing the repayment of the sum of £2,000 and further advances and interest thereon which Mortgage debt now amounts to the sum of £2,438. 5. 3 but all interest thereon has been paid up to the date of these presents and which said mortgage debt is with the interest thereon and the securities therefor by virtue of divers mesne assignments and devolutions vested in the said Charles Christopher Davie and the said Annie Prances Davie as joint tenants as to the said moneys absolutely and as to the said land and hereditaments in the said Charles Christopher Davie and the said Annie Prances Davie in fee simple subject to redemption (b) To an Indenture of Lease dated the 14th day of July 1911 and made between the Vendor of the one part and Harry Hooker of the other part whereby the said land and hereditaments coloured blue were granted unto the said Harry Hooker for the term of 14 years from the 25th December 1910.
AS to such part thereof as is coloured pink on the said plan To an Indenture of Mortgage dated the 21st day of December 1908 and made between the Vendor of the one part and the said Arthur Poster Griffith of the other part whereby the said land and hereditaments coloured pink were conveyed to the use' of the said Arthur Poster Griffith in fee simple by way of Mortgage for securing the repayment of the sum of £3,000 and interest thereon which said Mortgage debt and interest and the securities therefor remain vested in the said Arthur Foster Griffith as to the moneys absolutely and as to the said land and hereditaments in him in fee simple subject to redemption but all interest thereon has been paid up to the date of these presents AS to such part thereof as is coloured green on the said plan (a) To an Indenture of Mortgage dated the 2nd day of July 1905 and made between the Vendor of the one part and the said Adelaide Dorothy Tracy of the other part whereby the said land and hereditaments coloured green were conveyed to the use of the said Adelaide Dorothy Tracy in fee simple by way of Mortgage for securing the repayment of the sum of £600 and interest thereon which said mortgage debt and interest and the securities therefor remain vested in the said Adelaide Dorothy Tracy as to the moneys absolutely and as to the said land and hereditaments in her in fee simple subject to redemption but all interest thereon has been paid up to the date of these presents
(b) To such restrictive and other covenants as are set out in the first part of the Second Schedule hereto or are contained in the several Indentures specified in the said 2nd part of the Second Schedule hereto so far as the same affect the land and hereditaments coloured green and are still capable of being enforced.
NOW THIS INDENTURE WITNESSETH that in consideration of the sum of £17,750 for the purchase of the fee simple in possession of the said lands and hereditaments subject to the term of 14 years hereinbefore mentioned and to the said restrictive covenants mentioned in the Second Schedule hereto paid by the Corporation at the request of the Vendor in manner following that is to say: - The sum of £2,438. 5. 3, part of the said sum of £17,750 to the said Charles Christopher Davie and the said Annie Prances Davie in full discharge of the moneys owing to them under the said Indenture of Mortgage dated the 2nd day of April 1903 as aforesaid (the receipt whereof the said Charles Christopher Davie and the said Annie Prances Davie do hereby acknowledge) The sum of £3,000 a further part of the said sum of £17,750 to said Arthur Poster Griffith in full discharge of the moneys owing to him under the said Indenture of Mortgage dated the 21st day of December 1908 as aforesaid (the receipt whereof the said Arthur Foster Griffith doth hereby acknowledge) The sum of £600 a further part of the said sum of £17,750 to the said Adelaide Dorothy Tracy in full discharge of the moneys owing to her under the said Indenture of Mortgage of the 2nd day of July 1905 as aforesaid (the receipt whereof the said Adelaide Dorothy Tracy doth hereby acknowledge) And the sum of £11,711. 14. 9, the residue of the said sum of £17,750 to the Vendor (the receipt and payment in manner aforesaid of each said several respective sums making together the said purchase money of £17,750 the - Vendor doth hereby acknowledge) The said Charles Christopher Davie and Annie Prances Davie as MORTGAGEES by the direction of the Vendor hereby GRANT and the Vendor as Beneficial Owner hereby GRANTS AND CONFIRMS unto the Corporation the land and hereditaments coloured blue on the said plan and more particularly first described in the First Schedule hereto and the said Arthur Foster Griffith as MORTGAGEE by the direction of the Vendor hereby grants and the Vendor as BENEFICIAL OWNER hereby GRANTS AND CONFIRMS unto the Corporation the said land and hereditaments coloured pink on the said plan and more particularly secondly described in the First Schedule hereto and the said Adelaide Dorothy Tracy as MORTGAGEE by the direction of the Vendor hereby GRANTS and the Vendor as BENEFICIAL OWNER hereby GRAINS and CONFIRMS unto the Corporation the said land and hereditaments coloured green on the said plan and more particularly thirdly described in the First Schedule hereto.
TO HOLD all the said lands and hereditaments coloured respectively blue pink and green unto and to the use of the Corporation their successors and assigns in fee simple discharged from all principal moneys and interest intended to be secured by and from all claims and demands under the hereinbefore recited Indentures of Mortgage dated respectively the 2nd day of April 1903 the 2nd day of July 1905 and the 21st day of December 1908 but subject as to the said land and hereditaments coloured blue to the said term of 14 years granted by the hereinbefore recited Indenture of Lease dated the 14th day of July 1911 and as to the said land and hereditaments coloured green to the said restrictive covenants and other covenants

Not to exercise or carry on or permit or suffer to be exercised or carried on in or upon the said land and hereditaments coloured green or any part thereof or in or upon any messuage or messuages or other buildings which may be erected or hereafter to be erected or built thereon the trade or business of a distiller Brewer Alehouse Keeper Inn keeper Beershop keeper Beerhouse keeper Licensed Victualler Vintner Tavern keeper or Wine and Spirit Merchant or any of them and not to sell or permit to be sold in or upon the said land and hereditaments coloured green or any part thereof or in or upon any messuage or other buildings which may be erected thereon any beer ale porter wines spirits or intoxicating liquors whatsoever.
