LEASE of Lower Bevendean Farm in the Parish of Falmer and County of Sussex.

THIS INDENTURE made the third day of July One thousand nine hundred and eight BETWEEN STEYNING BEARD of Rottingdean in the County of Sussex Esquire (hereinafter called "the Lessor") of the one part and Frank John allcorn of Balneath Chailey in the County of Sussex farmer (hereinafter called "the Lessee") of the other part witnesseth that in consideration of the rents hereinafter reserved and the Lessee's covenants hereinafter contained the Lessor hereby demises unto the Lessee all that messuage or tenement barns stables buildings and several pieces or parcels of land situated in the parish of Falmer in the County of Sussex and known as lower Bevendean farm and containing in whole by estimation Two hundred and sixty acres or thereabouts and more particularly delineated on the plan hereto annexed and their in aged with the colour pink together with all ways easements and appurtenances whatsoever to the said premises belonging or appertaining that subject to a right of way for (end page 1) the owner or occupiers of the house and land now in the occupation of William Aylwin but intended to be occupied by Ernest Percival Beard land coloured blue on the said plan for all necessary purposes connected with the use and occupation of such house and land TO HOLD the same unto the Lessee for the term of seven years from twenty ninth day of September One thousand nine hundred and eight YIELDING and PAYING during the first two years of the said term the yearly rent of Two hundred pounds during the third year of the said term the yearly rent of Two hundred and twenty pounds and during the remainder of the said term the yearly rent of Two hundred and forty pounds such rents to be paid by equal half yearly payments on the twenty fifth day of March and the twenty ninth day of September in every year the first payment to be made on the twenty fifth day of March One thousand nine hundred and eight AND the Lessee herby covenants with the Lessor in manner following (that is to say) That the Lessee will pay the rents hereby reserved at the times and in manner aforesaid And will also pay and discharge all rates taxes assessments and charges whether parliamentary (end page 2) parochial or of any other description which now are or during the said term shall be imposed or charged upon the said premises or the Landlord or Tenant in respect thereof (except the Land Tax the Tithe Rent Charge and Landlord's Property Tax) And also will keep on leave the gates posts hedges and fences except the walls upon the said premises in good and tenantable repair on being found allowed by the Lessor sufficient converted timber for that purpose within the distance of ten miles And also will keep and leave the interior and exterior of the said messuage or tenement in buildings in good and tenantable repair on being found and allowed by the Lessor sufficient materials for that purpose within ten miles And also will permit the Lessor or his agent with or without workmen or others twice or oftener in every year during the said term at convenient hours in the day time to enter into and upon the said demised premises and view and examine the state and condition thereof and of all such decays defects and wants of reparation as shall be then and there found to give to the Lessee notice in writing to repair and amend the same within six calendar months then next following within which time the Lessee will repair and amend the same accordingly And also will (end page 3) not assign or underlet the said demised premises or any part thereof (except the house and land coloured blue on the said plan hereinafter mentioned) without the consent in writing of the Lessor first had and obtained but such consent shall not be unreasonably withheld And also will use and manage the said land in a good and husbandlike manner according to the custom of the country and will keep and leave the same in good heart and condition And also will stack in the barns and rickyards in the last year of the term hereby granted all corn grain and hay produced on the said premises (the corn and grain to be thereby thrashed out (and all the hay and straw chaff stubble and fodder to be there consumed by cattle in a husbandlike manner and the dung manure compost or soil therein arising to be left on the premises) for which purpose the Lessee shall have the use of such of the barns and yards as may be necessary until the first day of May next after the end of the term hereby granted And in the last year of the said term the Lessor or his incoming tenant shall be at liberty to enter upon the said premises for wheat season so soon as the crop for that year is cleared off (end page 4) in order to prepare the same for such season and may also sow seeds among the Lent or Summer Corn which is the Lessee shall harrow in And the Lessee will also leave for the Lessor or his incoming tenant all the hay straw and roots remaining unconsumed being paid or allowed for the same at a feeding price provided always and it is hereby agreed that at the expiration of the term hereby grant whether by effluxion of time or by notice as hereinafter provided the Lessor or the incoming tenant shall pay or allowed to the Lessee for all the hay straw and roots then on the said premises and for the dung and manure carried out and the carriage thereof for any dung in the yards and for all such cultivations and other things as shall according to the custom of the country be usually paid for by the incoming tenant according to the valuation of two impartial persons to be chosen by the parties respectively or in case of their disagreement according to the valuation of an umpire to be chosen by such valuers previously to their entry upon such valuation from the amount of which valuation any sum or sums of money that may be due to the Lessor in respect of any breach non-observance or non-performance of any covenant or agreement herein contained on the part of the Lessee or (end page 5) for rent in arrears is and are to be deducted provided also and it is hereby agreed that no Market Garden valuation shall arise at the exploration of the term herby created provided also and it is hereby declared that if the said yearly rents or any part thereof should be in arrears for the space of twenty eight days next after any of the days whereon the same ought to be paid as aforesaid with the same shall we shall not have been legally demanded or if there shall be any breach or non-observance or non-performance of any of the Lessee's covenants hereinbefore contained then and in any of the said cases it shall be lawful for the Lessor at any time thereafter to enter into and upon the said demised premises or any part thereof in the name of the whole to re-enter and the same to have again repossess and enjoy as in his former estate provided also and it is hereby declared that if either the Lessor or the Lessee shall be desirous of determining this Lease at the end of any year of the said term and of such desire shall give to the other of them twelve calendar months' previous notice in writing then and in such case at the end of such a year the term hereby granted shall cease but subject (end page 6) to the rights and remedies of the Lessor for or in respect of any rent in arrears or any breach of any of the Lessees covenants herein contained AND the Lessor hereby covenants with the Lessee to pay the Land Tax Tithe Rent Charge and Landlord's Property Tax And will find and provide sufficient timber for the necessary repairs of the gates posts and fences upon the said premises and the necessary materials for the repairs of the exterior of the said messuage or tenement in buildings within the distance of ten miles and that the Lessee pay the rents hereby reserved another observing and performing the covenants and conditions herein contained and on his part to be observed and performed shall and may peaceably and quietly possess and enjoy the said premises hereby demised during the said term without any lawful interruption from or by the Lessor or any person rightfully claiming from or under him provided always and it is hereby declared if any time the said E. P. Beard shall give up the possession of the said house and land coloured Blue on the said plan the Lessee shall have the option of taking a lease of the said house and land for the remainder of the term hereby granted at an annual rent of Twenty five pounds payable half yearly as hereinbefore (end page 7) provided and subject to the same terms conditions mutatis mutandis as those hereinbefore contained but the Lessee shall exercise such option within three calendar months after receiving notice in writing from the Lessor that such house and land will become vacant provided also and it is hereby agreed and declared that in case any of the buildings comprised in this lease shall be destroyed or damaged by fire during the said term then and so often as the same shall happen a just proportion of the rents hereby reserved according to the extent of the injury sustained shall cease and be suspended during so long a time as the said building or any part or part thereof shall remain uninhabitable or unfit to use And if any dispute shall arise between the Lessor and Lessee in regard to the amount of the abatement to be so made in the said rent or the period for which the said rent or any rent thereof shall be suspended the same shall be referred to Arbitration under the Arbitration Act 1889 PROVIDED ALSO and it is hereby declared that if at any time during the term hereby created the Lessor shall require any part of premises hereby demised the building purposes or for the development (end page 8) of his adjoining or adjacent lane then and in such case the Lessor may give to the Lessee six months notice in writing to determine this present Lease so far as regards such land which the Lessor requires on the twenty fifth day of March or the twenty ninth day of September next after such notice shall be given and thereupon this lease and term hereby created shall so far as such land which the Lessor requires cease and determine And the rents hereby reserved shall be reduced at the rate of not less than One pound per acre or part of an acre of land so taken by the Lessor and it is declared that where the context allows the expressions "the Lessor" and "the Lessee" used in these presents include respectively besides the said Steyning Beard his heirs and assigns and besides the said F. J. Allcorn his executors administrators and assigns in witness whereof the said parties to these presents have thereunto set their hands seals the day and year first before written.
