Will of Mr Frederick Allcorn and two Codicils dated respectively 7th September 1897 & 18 April 1900

I FREDERICK ALLCORN of the Rocks Crowborough in the Parish of Rotherfield in the County of Sussex Gentleman herby revoke all former Wills and Testamentary dispositions made by me and declare this to be my last Will and Testament I APPOINT my cousin John Alchorne of Uckfield in the said County Gentleman my Nephew William Allcorn of Pigsfoot Farm Hadlow Down in the said County Farmer my Daughter in Law Mary Allcorn the Wife of my Son Fred Allcorn and My Grandson Frank Allcorn the Son of the said Fred and Mary Allcorn (hereinafter called my Trustees) to be the Executors and Trustees of this my will I BEQUEATH the sum of Three hundred pounds which is secured to me by the joint promissory note of hand dated the 29th day of September 1894 of Samuel Gathorne Cornwall and Elizabeth Cornwall his Wife and also the further sum of Two hundred pounds unto the said Elizabeth Cornwall now residing at Streat in the said County for her absolute use and benefit but if the said Samuel Gathorne Cornwall and Elizabeth Cornwall shall pay off the said sum of Three hundred pounds so secured as aforesaid or any portion thereof in my lifetime then I give to the said Elizabeth Cornwall a further sum of Three hundred pounds or such Sum as will with the Two hundred pounds hereinbefore bequested and the balance then owing on the said Note of Hand bring up the legacy to the said Elizabeth Cornwall in amount to the sum of Five Hundred pounds the amount that I desire the said Elizabeth Cornwall shall benefit by and in this my Will I BEQUEATH the sum of Five hundred pounds to Jane Upperton the wife of Henry Upperton of Goudhurst in the county of Kent Farmer for her soul and separate use And if she shall die in my lifetime leaving issue I Give the said sum of Five hundred pounds to my Trustees in trust for such child or children of the said Jane Upperton as being a son or sons shall attain the age of 21 years of being the daughter or daughters shall obtain that age or marry and if more than one in equal shares and I declare that the income of the presumptive share of any infant under this trust shall be applicable for his or her maintenance under the statutory provisions in that behalf that if no children of the said Jane Upperton shall live to attain vested interest in the said legacy the same shall fall into my residuary estate I BEQUEATH to Mary Day of the Manor House in Rotherfield aforesaid the Granddaughter of my late wife Ann Allcorn the sum of Fifty pounds and I hearby direcT that the foregoing legacies shall be paid out of my personal estate I devise and bequeath all my real estate and the residue of my personal estate unto my Trustees upon trust that my Trustees shall sell call in and convert into money the same or such (end page 1)

part thereof shall not consist of money and child with an out of the monies produced by such sale calling in conversion and with and out of my ready money pay my funeral and testamentary expenses and debts and legacies bequeathed by this my Will or any Codicil hereto but so that the proceeds of Real Estate shall not be applied in payment of legacies unless the other monies applicable thereto under this trust shall be insufficient for payment thereof And shall invest the residue said monies with power for my Trustees from time to time to vary such investments And shall stand possessed of the said residuary trust monies and the investments for the time being representing the same (hereinafter called the residuary trust funds) upon trust to receive an applied incumbent thereof for the benefit of my son Fred Allcorn and his Wife the said Mary Allcorn and their children and I hereby declare that in the management and application of the interest of my residuary trust fund I GIVE my Trustees full discretionary powers to layout the income the union in the way that seems to lend to the most advantageous for my son his Wife and children and I declare that after the death of my said Son and his Wife by Trustees shall stand possessed of the residuary trust funds in trust to all the children of my said son who being sons shall attain the age of 21 years or being daughters shall attain that age or marry under that age in equal shares and if there shall be only one such child the whole to be paid in trust for that one child provided always that if any children of my son shall die in the lifetime of either of its parents leaving a child or children are and who being a son or sons shall attain the age of 21 years or being a daughter or daughters shall attain that age or marry under that age then and in every such case the last mentioned child or children shall take (and if more than one equally between them) the share which his her or their parents would have taken of and in the residuary trust funds if such parents had survived his her or their parents and attained the age of 21 years and I declare that my Trustees may at any time during the lives life of my said son and his wife or after their death at their own discretion raise any part or parts not exceeding together one moiety of the presumptive or expectant share of any grandchild of mine under this my will and apply the same for his or her advancement preferment or benefit as my Trustees shall think fit and I also declared that my Trustees may postpone the sale and conversion of any part of my real personal estate for so long as they shall think it advisable (end sheet 2)

to do so and that the rents profits and income to accrue from and after my decease of and from such part of my estate as shall for the time being remain unsold and unconverted shall after payment there out of all incidental expenses and outgoings be paid and applied to the person or persons and in the manner to whom and in which the income of the proceeds of such sale conversions would for the time being be payable or applicable under this my Will if such sale and conversion has been actually made and I also declare that all monies liable to be invested under this my Will may be invested on Government Securities or any other stocks funds or securities authorised by Law for trust funds or in the purchase of inscribed stock of any British Colony or on Mortgage of any leasehold houses or land in England or Wales held or any term having 60 years to run at the time of the investment and I also declare that the Executors and Trustees for the time being of this my Will may instead of acting personally employ and pay a Solicitor or other person to transact any business or do any act required to be done in connection with the administration of my estate or the trusts hereby declared including the receipt of payment monies and I hereby declare that the said John Allcorne William Allcorn and Frank Allcorn shall be paid from time to time a fair and reasonable sum for the trouble they will be put to in carrying out the trusts of this my Will in testimony whereof I the said Frederick Allcorn the Testator have to this my last Will and Testament contained in 3 sheets of paper set my hand this thirteenth day of June One thousand eight hundred and ninety six.

This is a codicil to be annexed to and taken as part of last Will and Testament of me Frederick allcorn of the Rocks Crowborough in the parish of Rotherfield in the County of Sussex gentleman which bears (end page 3)

date the Thirtieth day of June One thousand eight hundred ninety six whereas by my said will I have appointed my Cousin John Allcorne of Uckfield in the said County Gentleman my Nephew William Allcorn of Pigsfoot Farm Hadlow Down in the said County Farmer my Daughter-in-law Mary Allcorn the Wife of my son Fred Allcorn and my Grandson Frank Allcorn son of the said Fred and Mary Allcorn to be Executors and Trustees thereof now I hereby revoke the appointment of the said Mary Allcorn as such Executor and Trustee and I appoint my said son Fred all corn to be an Executor and Trustee of my said Will jointly with the said John Allcorne William Allcorn and Frank Allcorne in the place of the said Mary Allcorn and I declare that my will shall be construed in take effect as if the name of this said Fred Allcorn had been inserted throughout my said will instead of the name of the said Mary Allcorn and in all other respects I confirm my said will in testimony whereof I the said Frederick Allcorn the Testator have to this Codicil to my last Will and Testament set my hand the seventh day of September One thousand eight hundred and ninety seven.

A Codicil to be annexed to and taken as part of the last Will and Testament me Frederick Allcorn of The Rocks Crowborough in the Parish of Rotherfield in the County of Sussex Gentleman which bears date the 30th day of June 1896 I give to my granddaughter Rose Edith Allcorn daughter of my son Fred Allcorn a legacy of Four hundred and twenty pounds free from all legacy estate or other duties which I direct shall be paid out of my residuary estate AND I DIRECT that the sum due to me from Thomas Wickens shall be set apart to satisfy the said Legacy and in all other respects I ratify and confirm my said Will is altered by a Codicil thereto dated the 7th day of September 1897 in testimony whereof I the said Frederick Allcorn the (end page 4)

Testator have to this Codicil to my Will set my hand the 18th day of April 1900.
